The law establishes that the foreigner who has been obtained a temporary residence, free status, as a civil or common law spouse of a Costa Rican may, upon prior appointment before the Documentation Subprocess or another office authorized for that purpose, annually renew this condition. The Law establishes that, to do so, the interested person must provide:

a) Marriage certification issued by the Civil Registry of Costa Rica, with an issue date no older than two months at the time of submission of the renewal application. Common law marriages require the applicant to furnish a certification from the corresponding Court indicating that the common law marriage is valid on the date of renewal.

b) Demonstrate marital cohabitation, for which both spouses must present themselves to the Immigration Management Services Platform or corresponding Regional Delegation, to take the data ratification interview, as well as to provide any other evidence that proves cohabitation which must be signed by both spouses. If necessary, the Immigration Police may verify the information provided by the interested parties.

c) Proof of payment for the amount indicated at the time of requesting the appointment through the website or the 1311 service.

If the renewal is not carried out within a period of one year or if the corresponding requirements are not provided, the foreigner could be exposed to the cancellation of its immigration status.

La ley establece que la persona extranjera a la cual se le aprobó la residencia temporal, libre condición, como cónyuge de costarricense o se encuentre en unión de hecho con costarricense podrá, previa cita ante el Subproceso de Documentación u otra oficina habilitada para ese efecto, renovar anualmente esta condición. La Ley establece que, para ello, la persona interesada debe aportar:

a) Certificación de matrimonio emitida por el Registro Civil de Costa Rica, con una fecha de emisión no mayor a dos meses al momento de la presentación de la solicitud de renovación. En los casos en que se encuentre en unión de hecho deberá aportar certificación del Juzgado correspondiente donde se indique que el reconocimiento se encuentra vigente a la fecha de la renovación.

b) Demostrar la convivencia conyugal, para lo cual, deberán presentarse ambos cónyuges a la Plataforma de Servicios de la Gestión de Extranjería o Delegación Regional correspondiente, donde presente el trámite, a rendir la entrevista de ratificación de datos, así como para aportar cualquier otra prueba que acredite su convivencia la cual deberá ser firmada por ambos cónyuges. De ser necesario, la Policía de Migración podrá verificar la información rendida por los interesados.

c) Comprobante de pago por el monto indicado al momento de solicitar la cita por el sitio web o el servicio 1311.

De no realizar la renovación en el plazo de un año o de no aportar los requisitos correspondientes, la persona extranjera podría exponerse a la cancelación de su estatus migratorio.

Economically dependent fathers or mothers, and offspring (between eighteen and twenty-five years of age), in both cases, economically dependent on the temporary resident, may opt for a special immigration category. This special immigration category allows foreigners to reside in Costa Rica for one year (renewable).

Although this special category is a possibility to obtain legal immigration status in Costa Rica, its limitations are important. This category does not grant authorization to work, does not confer definitive permanence rights (for example, to opt for temporary or permanent residence) and is subject to the renewal of the temporary residence permit of the main applicant.

Los padres o madres dependientes económicamente, e hijos(as) mayores de edad hasta veinticinco años, en ambos casos, dependientes económicamente del residente temporal pueden optar por una categoría especial migratoria. Esta categoría especial migratoria permite a la persona extranjera residir en Costa Rica por un año (renovable).

Si bien esta categoría especial es una posibilidad para obtener un estatus migratorio legal en Costa Rica, sus limitaciones son importantes. Esta categoría no otorga autorización para laborar, no confiere derechos de permanencia definitiva (por ejemplo, para optar por una residencia temporal o permanente) y está sujeto a la renovación del documento de permanencia del titular (en este caso, que el residente temporal renueve su documento).

The aforesaid authorization is independent of any other authorization that is required by law to exercise a profession or operate a business in Costa Rica. The benefit that this authorization offers is that the foreigner is not exposed to any immigration sanctions (such as the cancellation of their immigration status) for working in Costa Rica.

The practice of certain professions such as medicine or law requires the homologation of university diplomas and incorporation into the respective professional association. Otherwise, the foreigner could be exposed to criminal consequences for the crime of illegal exercise of the profession, which is punishable by imprisonment of between three months to two years.

Not all professions require homologation and incorporation into a professional association. Individuals who practice journalism do not require it. The exercise of commerce does not require it either, except for authorizations or permits that are required by law to operate a business in Costa Rica.

La autorización que confiere la legislación migratoria a la persona extranjera unida con persona costarricense es independiente de cualquier otra habilitación que por ley sea requerida para ejercer una profesión u operar un negocio en Costa Rica. El beneficio que esta autorización ofrece es que la persona extranjera no se expone a ninguna sanción migratoria (como la cancelación de su estatus migratorio) por el hecho de laborar en Costa Rica.

El ejercicio de ciertas profesiones como la medicina o la abogacía requieren la equiparación de títulos universitarios e incorporación al Colegio profesional respectivo. De lo contrario, la persona extranjera podría exponerse a consecuencias penales por el delito de ejercicio ilegal de la profesión, el cual es sancionado con prisión de tres meses a dos años.

No todas las profesiones requieren la equiparación e incorporación a un Colegio profesional. Las personas que ejercen el periodismo no lo requieren. El ejercicio del comercio tampoco lo requiere, salvo las autorizaciones o permisos que sean obligatorios por ley para operar un negocio en Costa Rica.

A foreigner is entitled to have its application decided within three months after filing it before the Directorate General of Migration and Immigration. If a response is not issued within that period, the foreigner may file an amparo before the Constitutional Chamber. This does not require a lawyer, so the person can do it on its own and present it directly before the Court located in La Sabana. On our website we have some templates that may be useful.

Upon receiving the amparo, the Constitutional Chamber will study the case and if it considers that the case is admissible, it will notify Immigration and await its response on the allegations in the amparo. If the Court verifies that there has indeed been a delay, it will order Immigration to issue a response and notify the foreigner. The Constitutional Chamber does not order Immigration to approve an application, but rather orders it to give an answer – be it affirmative or negative – to the applicant. The processing of an amparo can take just a few weeks.

Before filing an amparo, it is essential to verify that the application and all supporting documents before Immigration are complete. If for any reason the person has omitted any document or has not complied with previous requests made by Immigration, it is likely that after filing the amparo the foreigner will have his/her application rejected. In case of doubt as to whether the file is complete, it is advisable to request a review of the file in Immigration.

Desde que una persona extranjera presenta una solicitud de residencia temporal ante la Dirección General de Migración y Extranjería tiene derecho a que su solicitud sea resuelta en máximo tres meses. De no obtener una respuesta en ese plazo la persona extranjera puede presentar un recurso de amparo ante la Sala Constitucional. Este recurso no requiere un abogado, por lo que la persona lo puede hacer por su cuenta y presentarlo directamente ante la Sala ubicada en La Sabana. En nuestra página web tenemos algunos machotes que pueden ser de utilidad.

Al recibir el recurso, la Sala Constitucional estudiará el caso y si considera que el caso es admisible, notificará a Migración y esperará su respuesta sobre lo alegado en el recurso presentado. Si la Sala verifica que en efecto ha habido un retraso en la resolución del caso, ordenará a Migración emitir una respuesta y notificar a la persona extranjera. La Sala Constitucional no ordena a Migración aprobar un trámite, sino que le ordena dar una respuesta – sea afirmativa o negativa – a la persona solicitante.  La tramitación de un recurso de amparo puede ser de apenas unas semanas.

Antes de presentar el recurso ante la Sala Constitucional es fundamental verificar que la solicitud y los requisitos estén completos ante Migración. Si por algún motivo la persona ha omitido algún documento o no ha cumplido con alguna prevención realizada por Migración, es probable que con el recurso de amparo la persona extranjera reciba una resolución de archivo de su solicitud y su permanencia en Costa Rica se vea en riesgo. En caso de duda de si el expediente está completo, es recomendable solicitar una revisión del expediente en Migración y revisar que el expediente esté listo para resolver.

It has recently been reported that at least three trans people have been able to process the new bicentennial biometric passport with their self-perceived name and gender. To carry out this procedure, it is necessary 1) that the person’s ID reflects his/her perceived name and gender and 2) that the person authorizes the change before the Immigration Authority.

Please note that passports cost 75 dollars plus 250 colones. The document will be valid for 10 years and issued 48 hours after being requested.

Recientemente se ha documentado que al menos tres personas trans han podido tramitar el nuevo pasaporte biométrico del bicentenario con su nombre y género autopercibidos. Para realizar este trámite es necesario 1) que la cédula de identidad de la persona refleje el nombre y género percibidos y 2) que por única vez la persona autorice el cambio ante DGME.

Les recordamos que el pasaporte tiene un costo de 75 dólares más 250 colones. El documento tendrá vigencia por 10 años y se obtiene 48 horas después de solicitado.
